Wisconsin does not have a statute addressing gestational surrogacy, but the cases Paternity of F.T.R. and Rosecky v. Schissel indicate that gestational surrogacy agreements are permitted.

Judgment: Must include EDD, child(ren)’s name, expected place of delivery, all parties’ dates of birth, places of birth and current addresses

Special Requirements: WI VR requires that we fill out their “Report of Birth Certificate Changes for Surrogate Birth” form (F-05032) and have the back stamped by local county clerk in CA

  • The date of the stamp must be the day of the birth or after the child is born. On the form, parent information goes at the top, babies’ information goes on the bottom.
  • Judgment should be sent to VR along with Form-05032, payment, and a return FedEx envelope:
