Gestational surrogacy is permitted for married couples and single intended parents and governed by the Code of Virginia Status of Children of Assisted Conception Sec. 20-156 et. seq. The statute imposes compensation restrictions. Parties may pursue pre-birth or post-birth establishment of parental rights, with the post-birth option appearing less onerous.
