While Pennsylvania has no statutory law governing gestational surrogacy, case law indicates that gestational surrogacy arrangements do not violate public policy.

Vital Records Information

Contacts: Legal Counsel, Sara Curish ( (717) 783-2500); Kylee Higgins, Supervisor of Special Services Unit ([email protected])

  • Any approvals for pre-birth court orders must come directly from Office of Legal Counsel.
  • Kylee Higgins indicated that legal counsel (who is now gone) prefers to have an order issued from a Pennsylvania court because an out-of-state court does not hold appropriate jurisdiction over another state’s birth records.
  • They can no longer guarantee that a pre-birth court order issued in California would be acceptable for an assisted conception birth occurring in Pennsylvania.
    • **Need to contact Legal Counsel for approval, case by case**
