There is no law in Kentucky addressing gestational surrogacy. Because it is not prohibited, gestational surrogacy may be practiced.

Important Notes:

  • Cases that involve donor eggs should be limited as they are only accepting on case by case basis
  • For IP’s who are genetically connected, it may be easier to have PBO done in KY to save clients cost
  • Courtney Good indicated that certain judges are wary of granting parental rights to IPs who have used a donor- in these cases, more luck domesticating than asking a KY court to issue the order
  • CFC and IRLG indicate that KY may be more open to accepting non-genetic IPs in certain circumstances, but because there is no surrogacy law and results vary dramatically by judge/county, please confirm any match where IPs are not married and both using their own gametes with Courtney!
